This application can be used for new membership registration or renewal of the existing membership.

OATH I/we, the undersigned, apply for membership of MASOM, I/we solemnly pledge to Allah and Chahardah Masomeen (AS) that I/we shall honor the Shia Islamic By-Laws and constitution of MASOM, to promote its objects and conduct myself/ourselves in an honorable manner.

By virtue of this signed oath, I/we agree not to seek or bring legal action against MASOM, actions of General Body or for differences or disagreements as between members and office bearers of MASOM.

RELEASE OF LIABILITY AGREEMENT


In consideration of the Executive Committee of MASOM reviewing and, if my membership is accepted, approving my membership application, I agree to the following:

1. Article V, Provision 2 of the Bylaws state that “Each and all member(s) present or past, agree not to seek legal action or bring lawsuit against action(s) of the General Body and its member on matter concerning MASOM, and in-lieu release and hold harmless to General Body any claims on matters present.” I consent to the foregoing language and agree not to support any litigation against members of MASOM for matters related to MASOM. I also consent to the Executive Committee’s decisions, past or present, in promoting this provision of the Bylaws.

2. RELEASE FROM LIABILITY. Therefore, I hereby RELEASE AND DISCHARGE MASOM, its members, officers, directors, and employees from any and all liability, claims, demands or causes of action (including claims for attorneys fees that I may have or may come to have) arising out of my membership application, my membership, or participation in MASOM. I specifically waive my right to bring a derivative action against MASOM and/or its officers and directors unless the bringing of said action is approved by the Resident Alim. Should there be a vacancy in the position of Resident Alim, I agree to not to bring a derivative action against MASOM and/or its officers and directors unless the bringing of said action is approved by a simple majority of the General Body present in a duly called General Body meeting.

3. ENFORCEABILITY. I agree that if any portion of this Agreement and Release of Liability is found to be unenforceable or against public policy, that only that portion shall fall and all other portions shall remain in full force and effect. I also specifically waive any unenforceability or any public policy argument that I may make or that may be made on my behalf.

4. I agree to indemnify and hold harmless MASOM, its members, officers, directors, and employees from all liability, claims, demands, or causes of action including attorneys fees and costs (including fees and costs of prosecuting or defending any claim I might make, or that might be made on my behalf, that is released or waived by this instrument) in any way connected to my membership application or my membership in MASOM.

5. If my membership is approved and a claim, demand, or cause of action should arise involving me and any of MASOM, its officers, directors, and employees, I agree that I will first present the matter to the Executive Committee. If I remains unsatisfied after the matter has been acted upon by the Executive Committee, or the matter is not acted upon for an unreasonable period of time, I will refer the matter to the Resident Alim for resolution pursuant to Islamic principles. Should there be a vacancy in the position of Resident Alim, I agree to present the claim, demand, or cause of action to the General Body at the next duly called General Body meeting where I will seek adjudication of the claim, demand, or cause of action through a resolution approved by a simple majority of the General Body present at the General Body meeting.

6. LEGAL RIGHTS. I have read and understand this agreement. It has been explained to me, and I expressly recognize that this Agreement and Release of Liability is a contract pursuant to which I am giving up legal rights, and it is my intention to do so.
